Fresh Twist in Daddy Lumba Marital Dispute: Odo Broni Files Counterclaim

A new development has surfaced in the ongoing legal tussle involving the late Highlife legend, Charles Kwadwo Fosu, popularly known as Daddy Lumba, as his partner, Odo Broni, has filed a counterclaim seeking official recognition as the musician’s lawful wife.

The counterclaim, lodged at the Kumasi High Court, also requests a judicial declaration that the late musician had divorced his wife, Akosua Serwaa, before his death.

Lawyer William Kusi, who represents Akosua Serwaa, confirmed that the legal documents had been filed in Kumasi. He explained that Odo Broni’s action challenges Akosua Serwaa’s marital status and adds another layer of complexity to the ongoing court proceedings over Lumba’s estate and funeral arrangements.

He further touched on the court’s recent ruling regarding who has the right to view the late musician’s body, noting that the judge ruled that only the person who deposited the body at the mortuary — or one with lawful authorisation — is permitted to do so.

“The court ruled that only the individual who sent the body to the mortuary can view it, unless there is legal permission for someone else. You can imagine how frustrating that is for his sisters, especially those who came from abroad and have not been allowed to see his remains,” Mr. Kusi remarked.

This comes after the Kumasi High Court, presided over by Her Ladyship Justice Dorinda Smith Arthur, dismissed an interlocutory injunction filed by Akosua Serwaa on October 28, 2025.

The injunction had sought to prevent the family head, Mr. Kofi Owusu Banahene, together with Odo Broni and Transitions Funeral Homes, from going ahead with arrangements for the late musician’s funeral.

The presiding judge ruled in favour of the family head, granting him authority to continue with the planned funeral while directing both parties to submit their legal documents by October 31, 2025, ahead of a Case Management Conference set for November 14, 2025.

The case continues to attract national attention as fans, friends, and family of the late music icon await the court’s decision on who rightfully qualifies as Daddy Lumba’s legal wife.
