Removal Attempts Against EC Chair, Special Prosecutor Collapse

Attempts to remove the Chairperson of the Electoral Commission and the Special Prosecutor from office have collapsed after the Chief Justice determined that the petitions filed against them failed to establish a prima facie case.

A statement issued on Wednesday, February 18, 2026, by the Spokesperson to the President and Minister for Government Communications, Felix Kwakye Ofosu, indicated that seven petitions were submitted by various individuals and groups seeking the removal of the Electoral Commission Chairperson, Jean Mensah, and her Deputies.

In addition, three separate petitions were filed for the removal of the Special Prosecutor, Kissi Agyabeng.

According to the statement, President John Dramani Mahama, acting in line with Article 146 of the 1992 Constitution and Section 15 of the Office of the Special Prosecutor Act, 2017 (Act 959), referred the petitions to the Chief Justice, Justice Paul Baffoe-Bonnie, on November 25, 2025, to determine whether they disclosed a prima facie case.

By a letter dated January 26, 2026, the Chief Justice informed the President that no prima facie case had been established to warrant further investigations or proceedings for the removal of the Electoral Commissioner, her Deputies, or the Special Prosecutor.

The decision effectively brings the constitutional process triggered by the petitions to an end, maintaining the officials in their respective positions.
